US Court Orders Freedom of Abrego Garcia from Immigration Detention

A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement lacks lawful basis.

"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her ruling.

The case stems from a erroneous deportation to El Salvador in March, which US authorities later acknowledged was an error. After his return to the United States to answer alien smuggling charges, he was held in federal detention.

In her order, the court pointed out that the government lacks a valid removal order, which prevents them from deporting Mr. Abrego Garcia "for now."

The legal proceedings center on conflicting claims. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently denies this claim.

He has also pleaded not guilty to the conspiracy charges, which are part of a ongoing trial in the state of Tennessee.

The judge, who was hearing his petition to removal in a federal court, ruled that he must now adhere to the conditions of his bond from custody in Tennessee. This order shifts his monitoring to the Tennessee court.
